Newly Discovered Evidence

At Eric Babos' 2005 trial, a 44.1 megabyte voice mail recording was introduced into evidence. The voice mail message contained a background voice and the voice of John Riebe, the deceased telling his ex wife that "someone" was at his house, and that they wanted the money that John owed them, and if she could go and pick up his check. This conversation took place minutes before John Riebe was murdered. The State contends whoever was at the house at the time of the call was the murderer. The background voice was analyzed by the F.B.I. and yielded no workable results.

The Babos family has obtained a shortened version of the longer, full recording of the voice mail message. Through new technology not available at the trial, a preliminary enhancement of the shorter recording has netted a background voice which sounds like it belongs to a man of African-American decent.

I submit, if the longer recording were made available for enhancement and voice comparison, additional evidence pointing to my innocence may be uncovered.

Prosecutor Julia Bates and Assistant prosecutor Andrew Lastra have denied my families request for the full 44.1 voice recording, and do not return the families calls. Without representation from an attorney we are getting nowhere.

I believe I have only one shot at requesting a new trial based on newly discovered evidence, and I understand this is a vitally important action for exoneration. Indeed it must be undertaken with care and formed properly.
